I represent people accused of crimes of all varieties,
including assaults, homicide, drug offenses, sex offenses,
theft, fraud, weapons cases, expungements, driving under the
influence, burglary, domestic violence, stalking, , and all
other serious crimes. I have been doing criminal defense
representation for 31 years, and was a felony trial
prosecutor before that, so I understand what the Prosecutor
wants and how to use that for your benefit. I estimate I
have tried over 100 criminal jury trials.
With criminal charges, time is critical. The best thing a
person who expects to be charged with a crime can do it
retain counsel early. Some of the best criminal defense work
I have ever done for clients is to help prevent criminal
charges from ever being filed to begin with. This happens
when, for whatever reason, the police and District Attorney
do not file criminal charges right away, but a period of
police investigation occurs first. In pre-charging
situations, I have the ability to gather up evidence and
facts that might influence the Prosecutor into not filing
any misdemeanor or felony charges. |

In one case, young woman accidentally ran over an elderly
woman on a highway exit ramp, who later died at the hospital. My
client was not charged at the scene, but after the victim died at
the hospital, the District Attorney was working up the file, and
manslaughter criminal charges were all but a certainty. I was able
to investigate the locale, find evidence that it was a terribly
dangerous site late in the afternoon when the setting sun was in
drivers’ eyes, and prove that many, many accidents had happened
there. In effect, it was the highway exit ramp that caused the
death, not my client. The D.A. carefully considered all the evidence
I presented to him and decided not to file any charges at all. This
is not presented here to imply that your case will necessarily end
this way, but I can guarantee that it won’t if you wait until after
the charges are filed to hire your criminal defense lawyer.
In addition, in pre-charging situations I am almost always able to
arrange with police to notify me if an arrest warrant issues, so
that I can calendar my client’s case, have him or her appear in
court voluntarily, arrange for bail ahead of time, and thereby avoid
the client’s spending any time in jail while his case is pending.
The police will not do this for un-represented suspects. Instead,
they may arrest him at work or at home on Friday afternoon and hold
him in jail until bail is arranged or until arraignment in court on
Tuesday. |
